These Terms of Service ("Terms") govern your access to and use of the websites, products, and services provided by Volcha Enterprises Limited ("Volcha", "we", "us", or "our"), including but not limited to:

• Jaza Kiti — event management and ticketing platform
• Fundi Sensei — AI-powered sales and lead generation agent
• Kiti Sensei — AI-powered event discovery and booking agent
• Custom web development, SEO, USSD, and consultancy services

By accessing or using any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

You must be at least 18 years old or have the consent of a legal guardian to use our services. When creating an account on any of our platforms, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Promptly notify us of any unauthorised use of your account.
• Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

Certain services and products require payment. By making a purchase, you agree to:

• Pay all applicable fees as described at the point of purchase.
• Provide valid and current payment information. We accept payments via M-Pesa, bank transfer, and other methods as indicated.
• Authorise us to charge your selected payment method for the total amount.

Refunds: All refund requests are handled in accordance with our Refund & Cancellation Policy. Event ticket refunds are subject to the event organizer's policy, which is displayed at the point of purchase on Jaza Kiti.

Our AI agents, Fundi Sensei and Kiti Sensei, are designed to assist users through conversational interfaces. By using these agents, you acknowledge that:

• AI-generated responses are provided for informational and assistance purposes and may not always be 100% accurate.
• You should not rely solely on AI advice for critical financial, legal, or medical decisions.
• Conversations may be logged and reviewed to improve service quality and for training purposes (anonymised where possible).
• You must not use AI agents to generate harmful, unlawful, or discriminatory content.

You agree not to:

• Use our services for any illegal, fraudulent, or unauthorised purpose.
• Interfere with or disrupt the integrity or performance of our systems.
• Attempt to gain unauthorised access to any part of our platforms or related systems.
• Copy, modify, distribute, sell, or lease any part of our services without written permission.
• Upload or transmit viruses, malware, or other malicious code.
• Scrape, crawl, or use automated means to access our platforms without consent.
• Resell tickets purchased via Jaza Kiti at inflated prices (ticket scalping).

All content, trademarks, logos, software, and materials available on our platforms are the property of Volcha Enterprises Limited or our licensors and are protected by Kenyan and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use our services for personal or internal business purposes. You may not reproduce, modify, create derivative works from, or commercially exploit any of our content without prior written consent.

To the fullest extent permitted by law, Volcha Enterprises Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to us in the 12 months preceding the claim, or KES 10,000, whichever is lower.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

We may suspend or terminate your access to our services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, all licences granted to you will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising from these Terms or your use of our services shall first be attempted to be resolved through good faith negotiation.

If negotiation fails, the dispute shall be resolved through mediation or arbitration in Nairobi, Kenya, in accordance with the Arbitration Act, Cap 49 of the Laws of Kenya.

We may update these Terms from time to time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of our services after such changes constitutes acceptance of the revised Terms.
